Terms and conditions for private commissions
01 General terms

Prices are subject to change based on demand.

I reserve the right to refuse any commission without providing a specific reason.
02 Payment

I accept payments in Euros (€) only, via bank transfer. Checks will not be accepted.

The process involves a digital quote; once validated, an invoice is issued.

Payment can be made in one or two installments after the quote is approved.

Do not send any payment before I have validated your commission request.

Completion time may vary from a few days to 2 months, depending on complexity, my current workload, or factors beyond my control (e.g., health issues).

You must validate each stage of the artwork (sketch, pencil, inking, flat colors, shading) before I proceed to the next.

High-Definition (HD) files are delivered only after full payment. Until the balance is settled, only low-resolution, watermarked files will be provided.

Transfer of the usage license occurs only upon full payment.

Files are print-ready. Please specify if you require a specific format.
03 Execution time and delivery

The price includes 3 rounds of revisions during the creation process.

Any additional changes requested after final validation, or resulting from vague initial instructions on your part, will incur extra charges (unless the error is mine).
05 copyright and usage
Golden Rule: Unless explicitly stated otherwise in a signed quote, the artist (SoSkuld) retains full intellectual property rights (copyright) to all created works.

What You Purchase (The Client):

A personal, non-exclusive, non-transferable usage license.

You May: Display the artwork in your home, use it as an avatar or wallpaper on social media (crediting the artist), and print it for private use.

You May Not: Sell the image, use it for a brand, book, merchandise, NFTs, or modify it without agreement.

Note: You possess the digital file, but not the commercial exploitation rights.

Ownership of Original Characters (OCs):

If the commission concerns an original character (OC) belonging to the client, the client retains exclusive ownership of the concept, name, backstory, and base design of said character.

The artist does not claim ownership of the character itself. The transaction covers solely the creation of the specific illustration (the final image).

In summary: The character belongs to you; the specific drawing created by the artist belongs to me.

What I Retain:

Full copyright of the artwork.

The right to display the work in my portfolio, on my social media, and in art books (except for portraits of real individuals, which are subject to discretion).

The right to pursue legal action against any unauthorized commercial use.

Copyright Violations:

Resale, commercial use, plagiarism (presenting the work as your own), and modification without consent.

Commercial use can be negotiated retrospectively.

🚫 STRICT PROHIBITION ON ARTIFICIAL INTELLIGENCE (AI) USAGE: It is strictly forbidden to use commissioned works, provided files (even low-resolution), or sketches to:

Train, feed, or improve generative AI models (text-to-image, image-to-image, etc.).

Generate derivative images via AI tools.
-
Integrate works into public or private datasets intended for machine learning.
Any violation of this clause will be considered a serious breach of copyright and will result in systematic legal action.

Personal Data: Collected information (name, email, project details) is used solely for order management and is never shared with third parties.
06 cancellation and refund

By the Client: The 40% deposit is non-refundable. If cancellation occurs after sketch validation, the full amount is due.

By the Artist: In case of major impediment (illness, force majeure), a full refund will be issued within 7 days. My liability ends there.

Unreachable Client: If the client does not respond to solicitations (step validation, balance payment) for a period of 30 days, the order is considered cancelled. The deposit is retained by the artist, and the artwork remains my exclusive property.
